Description of Work Activities
The services provided consist of unarmed concierge, guarding, and access control for public entities, companies, condominium administrations, associations, and private clients. Uniformed personnel are employed, equipped with identification badges, torches, personal man-down GPS emergency devices, Body Cams (where requested), and telephony equipment connected to the operations center.


Company Responsibilities
The Company declares that it holds a civil liability insurance policy covering third parties and/or its employees with a minimum coverage of €3,000,000.00, contracted with a leading insurance company. The Company assumes full responsibility for the performance of the concierge service in question and agrees to indemnify the Client against any claim—whether contractual or extra-contractual, including third-party claims—for any damage caused during service execution.


Responsibilities of the Contractor’s Personnel
Personnel are carefully selected and must possess:

  • Excellent moral standing and a clean criminal record (as certified by the judicial record and lack of pending charges)

  • Professional skills gained through experience in the security sector

  • Ability to interact appropriately with the public and external environments

  • Certifications and training in First Aid, Medium- and High-Risk Firefighting, and Workplace Safety


General Contract Conditions

Preamble
FSA Security S.r.l. (hereinafter “FSA”), headquartered in Modena (Tax Code and VAT No. 08807571214) and with its legal office in Naples, carries out—among other activities—the supply and commercialization of security systems to its end clients and/or the provision of unarmed day and night concierge services to those who contract with FSA Security S.r.l. For services requiring armed personnel or the technological support of an Operations Center (e.g., specialized video surveillance services with phone and radio alarm reporting), FSA Security S.r.l. entrusts operational management to one or more fully authorized security institutes of its choice. The contractual relationships between FSA Security S.r.l. and its Clients are governed by the following General Conditions.

Art. 1) Scope of Application
These General Conditions apply to all services offered by FSA Security S.r.l. as specified in the individual Particular Conditions of Contract (i.e., individual supply or service-contract agreements, letters of engagement, or technical data sheets) and are binding unless otherwise agreed in writing. They are made available and enforceable by publication on the website www.fsasicurezzaimpianti.it or by any other suitable means. FSA Security reserves the right to modify them at any time; the version published on the website at the time of contract signing shall prevail.

Art. 2) Object
By signing the contract and/or accepting the economic offer, technical data sheets, or issuing a purchase order, the Client acknowledges having received all prior information and reviewed the technical specifications of the service offered by FSA Security S.r.l., thereby accepting them in full.

Art. 3) Duration
Unless otherwise specified, each contract has a duration of one year and is tacitly renewed at its natural expiration unless terminated by registered letter 60 days before the expiry date. By signing the contract and/or accepting the offer, the Client waives the right to unilaterally cancel the order. Consumer clients (those purchasing for non-professional purposes) may withdraw from the contract without penalty within ten working days of signing.

Art. 3) Fees and Payments
The Client must make payment according to the terms and amounts specified in the contract, offer, or purchase order. Unless otherwise stated, payment shall be by bank transfer to FSA Security S.r.l. or by certified cheque, either in a single payment for one-off services or monthly for ongoing contracts. Prices are exclusive of VAT unless otherwise agreed in writing. For periodic maintenance or technical assistance contracts, agreed fees may be adjusted up or down in the event of documented changes in labor costs or general market prices; such adjustments are deemed accepted unless the Client withdraws with 90 days’ notice.

Art. 4) Liability
FSA Security S.r.l. shall not be liable for total or partial service disruption or delays not attributable to it, including force majeure events. It shall not be responsible for malfunction or damage caused by the provided systems or equipment. In warranty cases, FSA Security S.r.l. may, at its discretion, replace defective equipment with equivalent or similar items. Exclusions apply where malfunction arises from client misuse, tampering, or negligence; in such cases, any corrective intervention by FSA Security S.r.l. will be charged at cost.

For services involving armed personnel or Operations Center support, FSA Security S.r.l. entrusts those services to authorized security institutes; in case of breach or improper performance by such institutes, FSA Security S.r.l.’s liability is limited to 50% of one month’s service fee (VAT excluded).

Art. 5) Assistance
Ordinary assistance and maintenance services are provided only where expressly specified in the individual engagement letter or contract, under the terms and costs therein.

Art. 6) Client Obligations
The Client shall use the services for their intended personal purpose, in good faith and fairness, respecting contractual limits and refraining from exploiting the services for any purpose other than those purchased.

Art. 7) Termination and Withdrawal
Invoices must be paid by the agreed deadline, or otherwise within 30 days from invoice date. In case of Client default, FSA Security S.r.l. may terminate the contract under Art. 1456 of the Italian Civil Code and claim damages. If payment delay exceeds 15 days, FSA Security S.r.l. may terminate the contract and apply a penalty of 2% of the service value per day of delay.

Art. 8) Complaints
For any service complaints, FSA Security S.r.l. provides telephone, postal, and online contacts published and regularly updated on its website. Clients must use the indicated channels.

Art. 9) Governing Law and Jurisdiction
These General Conditions are governed by Italian law. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Naples and Modena, except when the Client is a consumer.

Art. 10) Privacy Policy
Pursuant to Art. 13 of Legislative Decree 196/2003, FSA Security S.r.l. informs that personal data collected will be processed on paper, electronically, and telematically solely to fulfill contractual and legal obligations and for administrative and commercial purposes, under measures ensuring confidentiality. Data provision is optional but necessary for service execution; refusal prevents contract establishment. The Data Controller is FSA Security S.r.l., with the Legal Representative as Data Protection Officer. Data may be shared with banks, insurers, and service providers only for contractual management; for promotional statistics, data may be processed without consent, though the data subject may object. Rights under Art. 7 of Legislative Decree 196/2003 (access, rectification, cancellation, opposition, etc.) may be exercised by written request to the Company’s address.


Firefighting
Our security operators are trained in medium-risk fire prevention, having completed the firefighting course provided by Ministerial Decree 10/03/98.
